Copyright policy

Members upload their own photos, videos, audio and words to Gig Heaven. Our terms of service say they must own that content or have permission to use it. If you think something on Gig Heaven uses your work without permission, tell us and we will deal with it. This page explains how, and applies wherever you are in the world.

How to tell us

Use the Report link next to the listing or review and choose Copyright, or use our report form. You can also email or write to our copyright agent:

So that we can act on it, your notice needs to include:

1. your name, postal address, telephone number and email address;
2. the work you say has been copied, for example a link to your original photo or a description of it;
3. where the copy is on Gig Heaven: the web address of the page, and which photo, video or text on it;
4. a statement that you believe in good faith that the use is not authorised by you, your agent or the law;
5. a statement that the information in your notice is accurate and, under penalty of perjury, that you own the copyright or are authorised to act for the owner;
6. your signature. Typing your full name at the end of an email is enough.

If something is missing we will tell you what, rather than ignore the notice.

What we do

A person on our team reads every notice. We aim to deal with it within 5 working days. If the notice is complete, we remove the content or block access to it, and we tell the member who posted it, with a copy of the notice so that they can respond. We will tell you when it has been done.

If your content was removed

If you are the member and you think we removed your content by mistake, or you have permission to use it, you can send us a counter-notice at the address above. It needs to include:

1. your name, postal address and telephone number;
2. what was removed and where it appeared before it was removed;
3. a statement, under penalty of perjury, that you believe in good faith that it was removed because of a mistake or because it was misidentified;
4. a statement that you consent to the jurisdiction of the US Federal District Court for the district where your address is or, if your address is outside the United States, for any district in which we may be found, and that you will accept service of legal papers from the person who sent the notice or their agent;
5. your signature. Typing your full name is enough.

We send a copy of the counter-notice to the person who sent the original notice. Unless they tell us within 10 working days that they have started court action to stop you using the content, we put it back between 10 and 14 working days after we received your counter-notice.

Members who repeatedly infringe

We keep a record of every copyright notice. We close the account of a member who repeatedly posts content they do not have the rights to use. We may also close an account after a single serious case, under clause 15 of our terms of service.

Please be accurate

Only send a notice or counter-notice if you are sure of your facts. In some countries, including the United States, a person who knowingly says something false in one can be liable for the other side’s costs and damages. If you are not sure whether a use needs your permission, you may want to take advice first.
